Question: "Do I have a case against my health care provider...

...for violation of HIPAA laws? I received an envelope in the mail , addressed to me, from my health care provider. When I opened the envelope it had a letter addressed to another patient. With this being said, the letter that was meant for me had to have been sent to someone else. There is no telling what was in the letter. I feel violated for this error".

Answer:Do you have a case? Maybe.

Have you contacted your provider to find out what was in the letter that was meant for you? How can you feel violated if you don't know what was in the letter? Have you even told your provider about this mistake? Do you know for a fact that your letter was sent to someone else? We live in a litigious society. Just because you may have a case doesn't mean that you should be in a hurry to pursue it. These questions are not meant to denigrate your case, but you will need to be prepared to answer them with some third party forms of prove in order to pursue your case.
