According to Tennessee law, a couple can file for a no-fault divorce if they have irreconcilable differences or if they have been living separately for at least two years without children. A no-fault divorce does not require proving any wrongdoing by either spouse and can be faster and cheaper than a fault-based divorce. However, a no-fault divorce still requires a mandatory "cooling off" period of 60 days after filing the complaint if there are no children, or 90 days if there are children. This means that the divorce cannot be finalized until after this period has elapsed.
A fault-based divorce, on the other hand, requires proving one of the grounds for divorce specified by the Tennessee law, such as adultery, desertion, cruelty, addiction, felony conviction, or pregnancy by another person. A fault-based divorce can be more contentious and expensive than a no-fault divorce, as it may involve more litigation and evidence. A fault-based divorce also has a variable timeline depending on the complexity of the case and the availability of the court.
According to a survey conducted by Martindale-Nolo Research in 2019, the average cost of a divorce in Tennessee was $12,600, with $9,800 being the average attorneys' fees. The survey also found that the average duration of a divorce in Tennessee was 11 months, with uncontested divorces taking an average of 7 months and contested divorces taking an average of 15 months.
Therefore, based on these facts, it can be concluded that the time required to be divorced in Tennessee depends on several factors, but it can range from 2 months to 2 years or more. The type of divorce (no-fault or fault-based), the presence of children, and the level of conflict between the spouses are some of the main factors that affect the duration of a divorce in Tennessee.
